1. Acceptance of Terms

By accessing or using FCTracker (the “Service”, also branded as “FACEIT Finder”) available at fctracker.org, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Service.

2. License

We grant you a non-exclusive, non-transferable, revocable license to use the Service for personal or team purposes. Commercial use, resale or redistribution requires our prior written consent.

3. User Obligations

• Do not perform automated scraping, bulk queries or any activity that overloads the Service.
• Do not attempt to reverse-engineer, decompile or otherwise tamper with the code or infrastructure.
• Use the data obtained solely in compliance with FACEIT and Steam API terms.

4. Intellectual Property

All logos, graphics, and code are the property of FCTracker. Third-party trademarks (FACEIT, Steam) belong to their respective owners.

5. Disclaimer of Warranties

The Service and all data are provided “as is” without warranties of any kind, whether express or implied. We do not guarantee accuracy, completeness or uninterrupted availability.

6. Limitation of Liability

To the maximum extent permitted by law, FCTracker shall not be liable for any indirect, incidental, special or consequential damages arising out of or in connection with the use of the Service.

7. User Content & DMCA

User-Generated Content:

The Service does not allow users to upload or submit content. However, if you submit feedback, suggestions, or any communications to us, you grant us a non-exclusive, royalty-free license to use, reproduce, and incorporate such content into the Service.

DMCA Notice:

If you believe that any content on our service infringes your copyright, please notify us in writing at fctrackersupport@gmail.com with the following information:

• A detailed description of the copyrighted work
• The location of the allegedly infringing content
• Your contact information
• A statement of good faith belief that the use is unauthorized
• A statement that the information is accurate and under penalty of perjury

9. Dispute Resolution

Governing Law:

These Terms are governed by and construed in accordance with the laws of the European Union. For users outside the EU, the laws of Poland shall apply.

Dispute Resolution Process:

1. Informal Resolution: If you have any dispute with us, we encourage you to contact us first at fctrackersupport@gmail.com to seek an informal resolution.
2. Mediation: If informal resolution fails within 30 days, either party may request mediation through a mutually agreed-upon mediator.
3. Arbitration: If mediation fails, disputes may be resolved through binding arbitration under the rules of the International Chamber of Commerce.
4. Court Proceedings: Nothing in this clause prevents either party from seeking injunctive relief in court for intellectual property infringement.

Jurisdiction:

Any disputes that cannot be resolved through the above mechanisms shall be subject to the exclusive jurisdiction of the courts of Warsaw, Poland.

Consumer Rights:

Nothing in these Terms affects your statutory rights as a consumer, including the right to seek resolution through consumer protection agencies in your jurisdiction.

10. Service Modifications & Termination

Modifications:

We reserve the right to modify or discontinue the Service at any time. For material changes that affect your use of the Service, we will provide at least 30 days' notice via prominent announcement on the website.

Termination:

We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including if you:

• Violate these Terms of Service
• Engage in fraudulent or illegal activities
• Overload our servers with automated requests
• Attempt to compromise the security of our systems

Effect of Termination:

Upon termination, your right to use the Service ceases immediately. We may delete any data associated with your use of the Service, except where we are required to retain it by law.

11. Severability & Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. These Terms constitute the entire agreement between you and FCTracker regarding the use of the Service.
